Court strikes down motion to halt sale of the Municipally owned Talisman lands to Westway Capital

On Monday, March 14, the Superior Court of Justice, Ontario ruled in favour of the Municipality of Grey Highlands, dismissing a motion brought forward by the Protecting Talisman Lands Association to halt the sale of the Municipally owned Talisman lands to Westway Capital.

Key highlights from the ruling include:

  • The Municipality has the right to sell the lands.
  • The Municipality followed proper due diligence under the Municipal Act.
  • There will be many layers of oversight through the planning process to ensure the public’s interest will be met in how the lands are used by the new owners.

“We are pleased with the judge’s ruling,” said Mayor Paul McQueen. “The Municipality never intended to keep these lands, and throughout this process, has worked in the best interests of all residents in Grey Highlands. These lands have a long history in our community. They are important to us. Their natural beauty will be protected as we balance the opportunities to foster a vibrant local economy. The community will have a say as Westway brings forward their plans and we look forward to future community engagement as we embark on this exciting new stage.”

The by-law finalizing the Agreement of Purchase and Sale was passed by Council on February 2. Westway Capital has until July 10, 2022, to close the sale and take ownership.

A Protect Talisman spokesperson deferred comment at this time as the group is evaluating their options.
